According to a new motion, the defense claims Arizona Department of Public Safety investigators showed up to the home of Merritt’s fiancée last week. They wanted her to answer more questions about the freeway shootings case.

DPS has already interviewed Dina Sauceda and threatened her with a domestic terrorism charge to get her to change her alibi to prove she was not with Merritt at the suspected times of the shootings.

The defense wants the court to appoint Sauceda a third party attorney.

Merritt appeared in court on Tuesday,  the judge denied the motion to question DPS Director Frank Milstead.
