PEORIA, AZ — Peoria police say the AMBER Alert suspect accused of kidnapping his non-custodial son Tuesday night, was taken into custody Wednesday afternoon.

Phoenix police say they were called to the area of 23rd Avenue and Cactus Road Wednesday afternoon where someone believed they saw the suspect, Eric Maes. Officers responded to the area and Maes fled on foot but was later found hiding in a nearby wash area.

Police say around 6:30 p.m. Tuesday, a domestic violence incident was originally reported near 91st Avenue and Deer Valley Road. Multiple people reported that a woman, later identified as Brittany Martie of Phoenix, was holding onto a vehicle as it was driving down the road.

Martie, 30, had been thrown off of the vehicle and was seriously injured. She was taken to the hospital where she died from her injuries.

Police say Maes reportedly jumped into the driver's seat of Martie's car while her 10-month-old child was inside. Witnesses say Martie tried to grab onto the car as it sped away.

The vehicle was later found abandoned, and the child also was located in good health, abandoned near 21st Avenue and Dunlap Road.
