Bullet enters apartment with mom, baby inside

Officials say a Phoenix mom was holding her baby in her apartment as a bullet smashed through her front window last week.

Court documents show that on Jan. 9 around 10:30 p.m. in the area of 35th Avenue and Indian School Road, shots were fired into the air and 19-year-old Cristian Michael Pequeno returned fire from his second-story balcony.

Police say that Pequeno fired six shots with his 9mm Ruger before it jammed. One of the bullets went through the common area and  through the front window of another residence where a woman and a baby were located at the time. The bullet lodged itself in the family room wall but did not penetrate into the baby's room.

Pequeno, who police say they found hiding in a van with friends smoking marijuana in the apartment parking lot, said he was in his apartment when someone called his named and fired several shots into the air. He admitted that he returned fire.

Pequeno has a felony juvenile record and now faces charges of endangerment, discharging a firearm in city limits and various drug charges.
