The Maricopa County Attorney's Office won't charge the president of the state Board of Education with assaulting schools chief Diane Douglas during a meeting.
County Attorney Bill Montgomery made the decision on Friday after reviewing reports submitted by the Department of Public Safety. He says there's no reasonable likelihood he can prove intent as the law requires.
DPS reports released last month show investigators determined board President Greg Miller touched Superintendent of Public Instruction Diane Douglas' arm during a dispute over who had the right to speak at an August meeting.
Miller told detectives he may have inadvertently touched the superintendent's arm while moving her microphone. Douglas says he assaulted her.
Douglas has been at odds with the board since February and unsuccessfully sued to exert control over board staff.
