Phoenix police say a man shot his girlfriend inside a home Friday morning while the woman was holding a 1-year-old baby.
Officers responded to the couple's home near 83rd Avenue and Buckeye Road around 1 a.m.
Police discovered Miguel Nieves, 41, had shot his 29-year-old girlfriend in the upper body area once while she was holding a baby. The woman was taken to a hospital for care but was later released.
Witnesses said they had heard the couple arguing both inside and outside the home along with glass shattering before hearing a gunshot. Nieves reportedly called police to inform them of the shooting after it happened.
Police said Nieves had originally told them he spotted a dark figure walking in a hallway of the home, who he thought was an intruder, when he fired once from a gun.
Three children were taken from the home and into the Arizona Department of Child Safety's care as a result of the incident, police said.
Nieves was taken into custody on charges of aggravated assault, endangerment, and the discharge of a firearm within city limits.
