The family attorney for a 3-year-old girl who was hit by a police cruiser on August 16 says the girl is in critical condition and is in a “medical sleep state.”

The attorney says the girl has had several surgeries since the accident, and had to have several pieces of her skull removed to allow space for swelling in her head.

The girl was one of several children standing near an ice cream truck when the accident happened in a neighborhood near 67th Avenue and Camelback Road. The driver of the ice cream truck told ABC15 that he handed the girl her ice cream, turned his back to go back to the freezer and heard the crash.

Phoenix police said the 35-year-old female officer who struck the child was alone in the car and is extremely upset by what happened.

Neighbors said the officer was leaving a vacant home on the block after responding to a call about abandoned dogs.

The family attorney declined to comment on whether or not the family would take legal action against the police department for the crash.
