Man arrested after pulling out gun, shooting at driver in Surprise drive-thru

SURPRISE, AZ — A man has been arrested for pulling out a gun and opening fire at a driver in a Surprise drive-thru.

The incident happened Tuesday around 7:30 p.m. outside Bubba’s Market near Greenway and El Mirage roads.

Police say the victim was in the drive-thru when two men approached his vehicle. One of the men began cursing at the victim and telling him to leave town.

As the victim attempted to back out of the drive-thru, 27-year-old Baltazar Aguirre can be seen on the victim's dash camera footage pulling out a gun and firing several shots. See video from the incident in the player above. **Viewer discretion advised.**

The victim’s vehicle was shot multiple times as he reversed and drove away.

The victim was not injured during the incident.

The Arizona Department of Public Safety and Surprise police worked together to take Aguirre into custody.

Aguirre faces charges for aggravated assault with a deadly weapon, as well as numerous probation violations.
